The Punjab and Haryana High Court has rejected the bail plea of ​​a man accused of cheating Rs 77.89 lakh on the pretext of sending applicants abroad and for obtaining study and work visa.

The court noted that the accused did not send the applicants abroad and did not return the advance to them.

Judge Kirti Singh said: “In recent times, the courts have been inundated with similar proceedings in which innocent families have been financially exploited by promising to send their children abroad. Courts have often emphasized the seriousness of such crimes due to the financial and emotional damage caused to families.”

These observations were made during the hearing of an application under Section 439 of the CrPC for granting regular bail to the petitioner in the case under Sections 406, 420 and 120-B of the IPC and Section 13 of the Punjab Tourism Professions (Regulation) Act, 2014.

The plaintiff’s lawyer argued that the students signed the contract after duly reading the terms of the contract and acknowledging their rights and responsibilities.

In the case of the complainant, it was admitted that she was a student and had enrolled to complete the course through online mode and the accused never promised her to provide any offer letter or any other document that she would be sent abroad , he added. applicant.

After hearing the submissions, the Court noted that the name of the complainant was specifically mentioned in the FIR and serious allegations were leveled against him that he along with his co-accused had cheated the complainants to the tune of Rs 77,89,000/-. under the pretext of sending them abroad and obtaining study and work visas for them, but they did not send the applicants abroad and did not return the above-mentioned money to them.

Moreover, the petitioner is a habitual offender with many other cases registered against him and there is every chance that he will evade trial, the judge added.

Consequently, the court rejected the petition and stated that it did not consider it appropriate to grant the applicant the right to regular bail.
